  3. Welcome to the ever-growing community of Netscape AOL Instant Messenger users! 
  4. This exciting and easy-to-use instant communications service allows you to see 
  5. when your Instant Messenger buddies are online and then communicate with them 
  6. instantly -- no matter how they access the Internet.

  8. When an Netscape AOL Instant Messenger buddy sends you an instant message, 
  9. youÆll get the message on a small pop-up screen, and you can respond instantly.  
  10. ItÆs that easy.  But, just like any terrific communications service -- the 
  11. telephone, for example -- there are bound to be pranksters who may try to contact 
  12. and bother you.  And, because AOL wants your Instant Messenger experience to be 
  13. the best it can be, we have designed a special feature for you to use against 
  14. such pranksters.  In the event you do get a crank instant message, you can use 
  15. our "Neighborhood Watch" feature to "hang up."  This feature empowers you to 
  16. prevent the crank instant messenger from contacting you again for a period of 
  17. time and also to warn others about him. This way, you can control with whom you 
  18. communicate on Netscape AOL Instant Messenger.  For your information, AOL 
  19. doesnÆt monitor the service or read, record or retain any messages, so if you 
  20. want AOL to know about a crank instant message, youÆll need to save and send the 
  21. message to AOL. While AOL expects that Neighborhood Watch will empower you 
  22. against most crank instant messengers, AOL  may also decide to terminate serious 
  23. offenders.

  26. letÆs get you registered.  Read the registration agreement below, and when youÆve 
  27. agreed to it, youÆll be all set to join the Netscape AOL Instant Messenger 
  28. Community!

  32. By clicking below, you warrant that you are eighteen years or older and agree to 
  33. use the Netscape AOL Instant Messenger(TM) software ("Software") and service 
  34. ("Service") as provided in this Registration Agreement.

  36. AOL may, in its sole discretion and at any time, modify or discontinue the 
  37. Service; limit, terminate or suspend your use of the Service; and/or with 30 days 
  38. advance notice, introduce charges for the use of the Service or make changes to 
  39. this Registration Agreement. To terminate your registration, simply discontinue 
  40. using the Service.

  42. You understand that you use the Service at your own risk and, that in general,  
  43. AOL provides no assistance other than the information posted on the AOL Web site 
  44. (including an AOL contact number) located at http://www.aol.com/aim/help.html.  
  45. AOL and its suppliers are in no way liable for any claims arising from your use 
  46. of the Service.

  48. The Service contains a Neighborhood Watch feature which allows Service users from 
  49. the Internet, in their sole discretion, to assess "warnings" against other Service 
  50. users.  These "warnings" may limit your use of the Service.  AOL and its suppliers 
  51. are not responsible for the imposition of "warnings," or for the availability to 
  52. other Service users of such warnings and information about your Service session 
  53. length or tenure on the Service.  You understand that Service users from AOL may 
  54. have other or additional Netscape AOL Instant Messenger features that are not 
  55. available to Service users from the Internet, e.g., a doorbell tool that allows 
  56. them to decide whether to accept a message from other AIM users.

  58. AOL grants to you a non-exclusive, limited license to use the Software, pursuant 
  59. to the terms hereof, to connect to the Service only, and you may not modify, 
  60. reverse-engineer, decompile, or disassemble the Software.

  62. THE SERVICE AND SOFTWARE ARE PROVIDED "AS IS," WITHOUT WARRANTIES
  63. OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES 
  64. ARE LEGALLY INCAPABLE OF EXCLUSION.  AOLÆS ENTIRE LIABILITY AND 
  65. YOUR EXCLUSIVE REMEDY WITH RESPECT TO USE OF THE SERVICE AND THE 
  66. SOFTWARE SHALL BE THE REPLACEMENT OF ANY SOFTWARE FOUND TO BE 
  67. DEFECTIVE.  NEITHER AOL, ITS EMPLOYEES, DISTRIBUTORS, SUPPLIERS, 
  68. DIRECTORS, NOR AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, 
  69. CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT 
  70. LIMITED TO LOST PROFITS, IN ANY WAY ARISING OUT OF OR RELATING 
  71. TO THIS AGREEMENT, EVEN IN THE EVENT SUCH PARTY HAS BEEN ADVISED 
  72. AS TO THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES OR 
  73. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF 
  74. LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES 
  75. OR JURISDICTIONS, AOLÆS AND ITS SUPPLIERSÆ LIABILITY SHALL BE 
  76. LIMITED TO THE EXTENT PERMITTED BY LAW.

  78. If any part of the Agreement is held invalid or unenforceable, that portion shall 
  79. be construed to reflect, the partiesÆ original intent, and the remaining portions 
  80. remain in full force and effect.  The laws of the Commonwealth of Virginia, 
  81. excluding its conflicts-of-law rules, govern the Agreement and your registration, 
  82. and you expressly agree that exclusive jurisdiction for any claim or dispute 
  83. arising from the use of the Service or Software resides in the courts of the 
  84. Commonwealth of Virginia.
